NOTE: THESE TERMS CONTAIN A MANDATORY ARBITRATION AGREEMENT AND CLASS ACTION WAIVER
Welcome to Finsibility. By accessing or using our mobile application, website (if applicable), related services, and communications with us (collectively, the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the Service.
1. Acceptance of Terms
By creating an account, accessing, or using Finsibility, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. These Terms constitute a legally binding agreement between you and Finsibility Inc. ("Finsibility," "we," "us," or "our").
2. Use of Service
2.1 License Grant
We grant you a limited, revocable, non-exclusive, non-transferable license to access and use the Service for your personal, non-commercial use, subject to your compliance with these Terms. This license does not include any right to resell or commercially use the Service or its content.
2.2 Service Availability and Modifications
We reserve the right to modify, suspend, or discontinue any part of the Service at any time, with or without notice. We do not guarantee that the Service will be available at all times or that it will be uninterrupted, secure, or error-free. We may perform scheduled or unscheduled maintenance that may temporarily interrupt access to the Service.
2.3 AI-Powered Features and Third-Party Dependencies
Certain features of the Service — including AI-assisted financial analysis, intelligent navigation, and AI voice narration — depend on third-party service providers (such as AI model providers and text-to-speech providers). These features are subject to the availability, performance, and usage limits of those third-party services, which are outside of our control.
You acknowledge and agree that:
- AI-powered features may be temporarily unavailable, degraded, or subject to usage limits due to factors including, but not limited to: third-party provider outages, API rate limiting or throttling, usage quota exhaustion, provider policy changes, network issues, or scheduled maintenance — whether on our end or on the provider's end
- We may implement usage limits, cooldown periods, or queuing mechanisms for AI-powered features to manage costs and ensure fair access across all users. These limits may vary by subscription tier and may change over time
- Temporary unavailability of AI-powered features does not constitute a failure to provide the Service. The core functionality of Finsibility — including creating, editing, and managing financial models, performing calculations and projections, viewing community content, and all manual features — operates independently of third-party AI providers and remains available regardless of AI feature availability
- We will make commercially reasonable efforts to maintain the availability and performance of AI-powered features, but we do not guarantee uninterrupted access to any feature that depends on third-party services
2.4 Permitted Use
You may use Finsibility only for lawful purposes and in accordance with these Terms. You agree not to:
- Use the Service in any way that violates any applicable federal, state, local, or international law or regulation
- Transmit any malicious code, viruses, worms, Trojan horses, or harmful data
- Attempt to gain unauthorized access to any portion of the Service, other accounts, computer systems, or networks connected to the Service
- Reverse engineer, decompile, disassemble, or otherwise attempt to derive the source code of the Service
- Use the Service to compete with Finsibility or for any commercial purpose without our express written consent
- Use automated systems (bots, scrapers, spiders) to access the Service without our prior written permission
- Interfere with or disrupt the Service or servers or networks connected to the Service
- Impersonate any person or entity or falsely state or misrepresent your affiliation with any person or entity
- Collect or store personal data about other users without their express permission
3. Accounts and Registration
3.1 Age Requirement
You must be at least 18 years old to use the Service. By creating an account or using the Service, you represent and warrant that you are at least 18 years of age and have the legal capacity to enter into these Terms. If you are under 18, you may not use the Service. If we discover that you are under 18, we will terminate your account immediately.
3.2 Account Creation
To access certain features of the Service, you must create an account. You agree to:
- Provide accurate, current, and complete information during registration
- Maintain and promptly update your account information
- Maintain the security of your account credentials
- Accept responsibility for all activities that occur under your account
- Notify us immediately of any unauthorized use of your account
3.3 Account Security
You are solely responsible for safeguarding your login credentials and for all activities that occur under your account. Finsibility is not liable for any loss or damage arising from your failure to protect your account credentials.
4. Subscription & Billing
4.1 Subscription Plans
Certain features of the Service may require a paid subscription. Finsibility offers two subscription tiers: Basic and Premium. Each tier may be available on a monthly or annual billing basis, as displayed in the Service at the time of purchase. By subscribing to any plan, you agree to pay the applicable fees for your chosen tier and billing cycle.
4.2 Automatic Renewal
Subscription plans (Basic and Premium) automatically renew at the end of each billing period (monthly or annual, as applicable) unless you cancel your subscription before the renewal date. For subscriptions purchased through Apple App Store or Google Play Store, cancellation must be managed through the respective store's subscription management system. For direct subscriptions, you may cancel through your account settings. Cancellation will take effect at the end of the current billing period.
4.3 Payment Terms
- All fees are charged in advance for the applicable billing period
- Payment processing is handled by third-party payment processors (Apple, Google, or other payment providers)
- Fees are non-refundable except where required by applicable law (including consumer protection laws in your jurisdiction)
- We reserve the right to change our pricing with advance notice (see Section 4.6 — Price Changes)
- If payment fails, we may suspend or terminate your subscription access
- You are responsible for any taxes applicable to your subscription
4.4 Scope of Subscription
Your subscription provides access to the Finsibility platform and its core features, including the ability to create, edit, manage, and analyze financial models, access community content, and use the Service's calculation and projection tools. AI-powered features (such as AI-assisted analysis, intelligent navigation, and AI voice narration) are included as supplementary features that enhance the Service but are not the sole basis of your subscription. Temporary unavailability, throttling, or usage limits on AI-powered features (as described in Section 2.3) do not reduce the value of your subscription or entitle you to a refund, credit, or other compensation.
4.5 In-App Purchases and Virtual Currency
4.5.1 Rocket Coins
The Service offers a virtual currency called "Rocket Coins" that can be purchased through the Apple App Store or Google Play Store. Rocket Coins are used to access certain AI-powered features within the Service, such as AI-assisted analysis, portfolio tours, and voice narration. By purchasing Rocket Coins, you acknowledge and agree that:
- Rocket Coins are virtual items with no real-world monetary value. They are not currency, are not redeemable for cash, and have no value outside the Service.
- Rocket Coins are non-transferable. You may not sell, trade, gift, or otherwise transfer Rocket Coins to any other user or third party.
- Rocket Coins are non-refundable except where required by applicable law or the refund policies of the Apple App Store or Google Play Store.
- We reserve the right to modify the cost, availability, and functionality of Rocket Coins — including the features they unlock and the number of coins required — at any time, with or without notice.
- Rocket Coin balances reset monthly. At the beginning of each calendar month, your Rocket Coin balance is reset to the allocation associated with your current subscription tier (e.g., Free, Basic, or Premium). Unused Rocket Coins — including coins purchased through in-app purchases — do not roll over and are not carried forward. You are responsible for using your Rocket Coins within each monthly cycle.
- We may modify the Rocket Coin system at any time, including tier allocations, reset schedules, or the system as a whole. In such an event, we will make reasonable efforts to provide advance notice.
4.5.2 Themes and Non-Consumable Purchases
The Service may offer cosmetic themes, skins, or other non-consumable digital items for purchase. These items are licensed to you for personal use within the Service and remain available for the duration of your account, subject to these Terms. Non-consumable purchases are non-transferable and are tied to your account.
4.5.3 General In-App Purchase Terms
All in-app purchases are processed through the Apple App Store or Google Play Store and are subject to the respective store's terms and refund policies. Finsibility does not directly process payments for in-app purchases. You are responsible for all purchases made through your account, including unauthorized purchases that result from your failure to secure your device or account credentials.
4.6 Price Changes
We may change the pricing of our subscription plans (Basic and Premium) from time to time. If we increase the price of your subscription, the following applies:
- Your current billing period is always honored. You will never be charged more than the price you agreed to for the remainder of your active billing period (whether monthly or annual). Price increases only take effect at your next renewal date.
- We will provide at least 30 days' advance notice of any price increase before your next renewal. Notice will be provided through one or more of the following: in-app notification, email to the address associated with your account, or through the applicable App Store notification system.
- For subscriptions managed through Apple App Store or Google Play Store, price increases are subject to the respective store's price increase consent policies. This may require your affirmative consent before the new price takes effect. If you do not consent to the new price through the store's process, your subscription may not renew and will expire at the end of your current billing period.
- For direct subscriptions (if applicable), if you do not wish to continue at the new price, you may cancel your subscription before the renewal date. If you do not cancel, your continued use of the Service after the new price takes effect constitutes acceptance of the updated pricing.
- You will not be charged retroactively. No price increase will apply to a billing period that has already been paid for.
4.7 Refunds
Refunds are provided only as required by applicable law or at our sole discretion. Subscription fees are generally non-refundable once the billing period has commenced. We do not provide prorated refunds for the unused portion of a billing period (e.g., if you cancel mid-month or mid-year).
5. Financial Projections and Forecasts Disclaimer
5.1 NOT FINANCIAL ADVICE
FINSIBILITY IS NOT A FINANCIAL ADVISOR, BROKER, INVESTMENT ADVISOR, FINANCIAL PLANNER, OR FIDUCIARY. THE SERVICE PROVIDES INFORMATIONAL TOOLS AND PROJECTIONS BASED ON MATHEMATICAL MODELS AND USER-PROVIDED ASSUMPTIONS. WE DO NOT PROVIDE PERSONALIZED FINANCIAL ADVICE, RECOMMENDATIONS, OR GUIDANCE REGARDING SPECIFIC INVESTMENT DECISIONS, FINANCIAL PRODUCTS, OR STRATEGIES. WE DO NOT PROVIDE PORTFOLIO OPTIMIZATION, PORTFOLIO REBALANCING, OR ANY FORM OF MANAGED ADVISORY SERVICES. NO FIDUCIARY DUTY, ADVISORY RELATIONSHIP, OR DUTY OF CARE IS CREATED BETWEEN YOU AND FINSIBILITY BY YOUR USE OF THE SERVICE.
Finsibility is a peer platform. Where users share models, analyses, or projections with each other through the community feed, any such sharing is between those users. Finsibility does not assume an advisory role, does not validate the suitability of shared content, and bears no responsibility for decisions made based on peer-shared content.
5.2 Projections Are Based on Assumptions
All financial projections, forecasts, calculations, and analyses generated by the Service are based on:
- Assumptions and inputs you provide (interest rates, growth rates, contribution amounts, timeframes, etc.)
- Mathematical models and formulas that apply general financial principles
- Historical data and market information that may not reflect future conditions
- Simplified scenarios that may not account for all real-world variables
THESE PROJECTIONS ARE NOT GUARANTEES, PROMISES, OR ASSURANCES OF FUTURE FINANCIAL OUTCOMES. Actual results may differ materially from projected results due to numerous factors including, but not limited to:
- Changes in market conditions, interest rates, or economic factors
- Unforeseen events, market volatility, or economic downturns
- Changes in tax laws, regulations, or government policies
- Individual circumstances, risk tolerance, or financial goals
- Errors in input data or assumptions
- Limitations in the mathematical models used
5.3 No Guarantee of Future Performance
PAST PERFORMANCE AND PROJECTED PERFORMANCE ARE NOT INDICATORS OF FUTURE RESULTS. The Service cannot and does not guarantee:
- That any investment, financial product, or strategy will achieve specific returns
- That projections will be accurate or realized
- That you will achieve your financial goals
- That any financial decision based on the Service will be profitable or suitable for your circumstances
5.4 Due Diligence Required
YOU ACKNOWLEDGE AND AGREE THAT:
- You must conduct your own independent research and due diligence before making any financial decisions
- You should ALWAYS consult with qualified financial professionals (certified financial planners, investment advisors, tax professionals, attorneys) before making significant financial decisions. The Service is a social calculator that provides projections and analysis, not a substitute for professional financial advice
- You are solely responsible for evaluating the accuracy, completeness, and usefulness of any information, projections, or analyses provided by the Service
- You should not rely solely on the Service's projections, calculations, or analyses when making financial decisions
- You understand that financial decisions involve risk and that you may lose money
- Professional consultation is essential for complex financial decisions, tax planning, investment strategies, estate planning, and any decision that could significantly impact your financial well-being
5.5 Limitations of Financial Models
The Service uses mathematical models to generate projections, but these models have inherent limitations:
- Models are simplifications of complex real-world financial systems
- Models may not account for all relevant factors or edge cases
- Models assume certain conditions that may not persist
- Models may use historical data that may not predict future trends
- Different models may produce different results for the same inputs
- For discounted cash flow (DCF) calculations, models make assumptions of fixed risk rates that are pegged to the specific model type. These risk rates are standardized assumptions and may not reflect your actual risk profile, market conditions at the time of your decision, or the true risk characteristics of specific financial products or investments. The fixed risk rates used in calculations are not personalized to your circumstances and should not be interpreted as risk assessments or recommendations.
5.5.1 Model Versioning and Continuous Improvement
Models Cannot Tell the Future: Financial models are planning and analysis tools, not crystal balls. They cannot predict or guarantee future outcomes. All models are based on assumptions and mathematical formulas that attempt to simulate potential scenarios, but the future is inherently uncertain.
Model Versioning: Finsibility versions all financial model templates to track improvements and changes over time. Each model template has a version identifier that allows us to maintain accuracy and transparency about the underlying calculations.
Commitment to Improvement: We are committed to continuously improving the accuracy and reliability of our financial models. This includes:
- Internal bug discovery and fixes: We regularly review and test our models to identify and correct errors, calculation issues, or logical flaws
- External bug discovery: We welcome and investigate reports of potential issues from users, financial professionals, or other stakeholders
- Accuracy improvements: We update models to incorporate better mathematical approaches, more accurate formulas, or improved handling of edge cases
- Regular updates: Model templates may be updated periodically to reflect improvements, bug fixes, or enhanced accuracy
Model Updates and Your Data: When we update a model template, existing financial models you have created may continue to use the version that was active when they were created, or they may be updated to use the latest version, depending on the nature of the update. We will make reasonable efforts to maintain backward compatibility, but significant improvements may require model recalculation.
No Guarantee of Perfection: Despite our commitment to accuracy and continuous improvement, we cannot guarantee that models are free from errors or that they will always produce accurate results. Like any software or mathematical tool, models may contain bugs, calculation errors, or limitations that we have not yet discovered. You should always verify important calculations independently and consult with qualified financial professionals before making significant financial decisions.
5.6 Market and Investment Risks
ALL FINANCIAL DECISIONS INVOLVE RISK, INCLUDING THE RISK OF LOSS OF PRINCIPAL. The Service does not account for all types of risks, including but not limited to:
- Market risk and volatility
- Credit risk and default risk
- Liquidity risk
- Inflation risk
- Regulatory and tax risk
- Currency risk (for international investments)
- Concentration risk
YOU ASSUME ALL RISKS ASSOCIATED WITH ANY FINANCIAL DECISIONS YOU MAKE, WHETHER OR NOT YOU USED THE SERVICE TO INFORM SUCH DECISIONS.
5.7 No Endorsement of Financial Products
The Service may allow you to model various financial products, instruments, or strategies. THE INCLUSION OF A FINANCIAL PRODUCT, INSTRUMENT, OR STRATEGY IN THE SERVICE DOES NOT CONSTITUTE:
- An endorsement, recommendation, or solicitation to purchase or sell
- A representation that such product, instrument, or strategy is suitable for you
- Financial advice regarding such product, instrument, or strategy
FINSIBILITY ENDORSES NO FINANCIAL PRODUCTS, INSTRUMENTS, OR STRATEGIES. The Service is a neutral platform that provides tools for modeling and analysis. Any financial products, instruments, or strategies that appear in the Service are included solely for informational and modeling purposes.
5.8 Community Feed and Model Ecosystem
5.8.1 Model Alternatives and Visibility
The Service includes a community feed and ecosystem feature that surfaces alternative financial models from our community of users. IMPORTANT DISCLAIMERS:
- We provide visibility into models, not financial advice. The Service allows you to view, compare, and analyze financial models created by other users in our ecosystem. This visibility is provided for informational purposes only. Finsibility does not provide portfolio optimization, portfolio rebalancing, or financial advisory services of any kind.
- Peer-to-peer platform, not an advisor. Finsibility is a platform that enables peers to share financial models and analysis. Any advisement, suggestion, or recommendation exchanged between users is solely between those users and occurs outside the scope of Finsibility's responsibilities. Finsibility does not mediate, validate, or assume any advisory duty in connection with user-to-user interactions.
- Community contributions are NOT guarantees of future outcomes. All models, projections, and analyses contributed to the community feed by users or partners are based on assumptions and mathematical formulas. No one — not Finsibility, not community contributors, and not our AI tools — can predict or guarantee future financial outcomes. The future is inherently uncertain, and all projections should be treated as hypothetical scenarios, not promises.
- Computational analysis vs. financial advice. Finsibility performs mathematical and computational analysis of filled-out model templates. This analysis may include calculating financial metrics (such as net present value), aligning time horizons across models, and generating comparative calculations. However, this computational analysis does NOT constitute financial advice, suitability evaluation, or recommendations. We do not evaluate, assess, or recommend which models or alternatives are suitable for your circumstances, risk tolerance, or financial goals. The computational analysis is purely mathematical and informational.
- AI-Mode Privacy Measures. When you use AI-powered features (such as intelligent navigation, workflow automation, form filling, narration, and comparative analysis), we apply multiple layers of data sanitization on both your device and our servers to remove personally identifiable information before data reaches any AI provider. All AI features are gated behind explicit user consent within the app. Please refer to our Privacy Policy (Section 10) for full details on what data is and is not sent to AI providers, and the specific safeguards we apply.
- Bulk Document Import (Creator Accounts). The bulk document import feature is available exclusively to Creator accounts. Unlike the standard AI-assisted features described above, bulk document import sends the entire, unsanitized contents of your uploaded document to our AI service provider. Before any document is processed, you will be presented with a clear data disclosure that you must explicitly acknowledge. You are solely responsible for reviewing your documents for sensitive information before uploading. Consumer accounts must add items manually or use the standard privacy-preserving AI features. Please refer to our Privacy Policy (Section 10, "Bulk Document Import") for full details on what data is sent, safeguards, and supported formats.
- AI Voice Narration. The Service includes an optional AI voice feature that provides spoken narration of analysis results using a third-party text-to-speech service. Voice narration requires your explicit consent and can be disabled at any time from the Voice Assistant settings. When voice narration is disabled, no data of any kind is transmitted to the voice provider. Voice narration is provided for convenience and accessibility; the spoken content is informational only and does not constitute financial advice. Please refer to our Privacy Policy (Section 10, "AI Voice Narration") for full details on what data is and is not sent to the voice provider.
- Model alternatives are community-driven. The models surfaced in our ecosystem are created by community members and may reflect their individual assumptions, strategies, or perspectives. These models are not reviewed, verified, or endorsed by Finsibility.
- You are responsible for evaluation. You are solely responsible for evaluating any model alternatives, understanding their assumptions, interpreting the computational results, and determining whether they are relevant, suitable, or useful for your purposes.
5.8.2 Community-Driven Analysis Services
The Service may provide community-driven analysis features, including:
- User-generated content, comments, and discussions about financial models
- Community voting, rankings, or ratings of models
- Shared financial scenarios and comparisons
IMPORTANT:
- Community content is not financial advice. All community-generated content, analysis, comments, and discussions are provided by users and do not represent the views, opinions, or recommendations of Finsibility. Community projections are hypothetical scenarios based on assumptions — they are NOT guarantees or predictions of future outcomes.
- We do not verify community content. Finsibility does not review, verify, validate, or endorse any community-generated content, analysis, or projections. Community contributors are peers, not licensed financial advisors, and their contributions should not be treated as professional advice.
- Use at your own risk. You acknowledge that community content may be inaccurate, incomplete, or unsuitable for your circumstances. You should independently verify any information obtained from community sources and consult with qualified financial professionals before acting on it.
- We are not responsible for community content. Finsibility is not responsible for, and disclaims all liability arising from, any community-generated content, analysis, projections, or any financial decisions you make based on them.
5.8.3 Partner-Created and Co-Authored Models
We reserve the right to co-author pre-filled financial models with external partners (such as charities, financial institutions, educational organizations, or other entities) and make these models available in our community feed. These partner-created models may include:
- Pre-filled parameters showcasing specific financial products, rates, or opportunities
- Educational models demonstrating financial concepts or strategies
- Promotional models highlighting opportunities from partner organizations (e.g., charity donation opportunities, new financial product APRs, etc.)
IMPORTANT DISCLAIMERS:
- Partner models are not endorsements. The inclusion of partner-created models in our community feed does not constitute an endorsement, recommendation, or approval by Finsibility of the partner organization, their products, services, or the specific financial opportunity presented
- We do not verify partner models. While we may work with partners to create models, we do not independently verify the accuracy, completeness, or suitability of partner-created models
- Partner models are informational only. Partner-created models are provided for informational and educational purposes only. They do not constitute financial advice, recommendations, or solicitations
- You are responsible for evaluation. You are solely responsible for evaluating any partner-created models, understanding their assumptions, and determining whether they are relevant or suitable for your circumstances
- No financial advice. Partner-created models do not constitute personalized financial advice, and you should consult with qualified financial professionals before making any decisions based on these models
5.8.4 No Endorsement of Community Feed Models
FINSIBILITY ENDORSES NO MODELS, ALTERNATIVES, OR STRATEGIES SURFACED THROUGH THE COMMUNITY FEED OR ECOSYSTEM FEATURES, INCLUDING PARTNER-CREATED MODELS. The inclusion of a model in our community feed (whether user-created or partner-created) does not constitute:
- An endorsement, recommendation, or approval by Finsibility
- A representation that the model is accurate, suitable, or appropriate for any purpose
- Financial advice regarding the model or its underlying assumptions
- A guarantee that the model will produce the projected results
The community feed and ecosystem features are provided solely to give you visibility into different modeling approaches and alternatives. All community feed projections are hypothetical and are NOT guarantees of future outcomes. No one can predict the future. You must conduct your own due diligence and consult with qualified financial professionals before making any decisions based on community feed models.
5.9 Professional Users and Third-Party Relationships
Finsibility is an open platform for sharing financial projections and models. Any individual — regardless of their professional background, credentials, or licensure — may choose to use the Service. Financial advisors, analysts, accountants, planners, or other financial professionals may use the Service to create, share, or publish financial models through the community feed or other features. Finsibility has no ability or obligation to verify, monitor, or restrict users based on their professional background, credentials, or licensure status.
IMPORTANT:
- Finsibility does not verify credentials. We do not verify, validate, or represent the professional status, qualifications, licenses, or credentials of any user. The presence of content from a user who identifies as or appears to be a financial professional does not mean Finsibility has vetted, approved, endorsed, or supervises that individual or their content.
- No professional relationship through Finsibility. If a financial professional uses the Service to share models, projections, or analyses, any professional-client, advisory, fiduciary, or other relationship arising from that content exists exclusively between that professional and the individuals who choose to rely on it. Finsibility is not a party to, and bears no responsibility for, any such relationship. Finsibility does not supervise, direct, review, or oversee any professional user's activities on the platform.
- Finsibility is a neutral platform. We provide tools for creating and sharing financial projections. Content in the community feed may be ranked, sorted, or surfaced using automated algorithms based on factors such as data completeness, relevance, community engagement, and other signals. This automated ranking does not constitute editorial review, professional vetting, or endorsement of any content or its contributors. Finsibility may also employ automated quality metrics, abuse-detection systems, content flagging, and administrative oversight measures — and may update these systems at any time — to promote platform safety, trust, and integrity for all users. None of these measures represent an endorsement, guarantee of accuracy, or professional approval of any content. All content on the platform — whether posted by a licensed professional, an industry analyst, or an individual user — is subject to the same disclaimers and limitations set forth in these Terms.
- Do not assume professional status. You should not assume that any user on the platform is a licensed or qualified financial professional, and you should not rely on any content on the platform as professional financial advice. If you need professional financial advice, you should independently engage a qualified professional outside of the Finsibility platform.
- Professional users are solely responsible. Any financial professional who uses the Service is solely responsible for their own compliance with applicable laws, regulations, licensing requirements, and professional standards. Finsibility makes no representations regarding whether the Service is suitable for use in the delivery of professional financial services and disclaims all liability arising from such use.
6. Third-Party Services and Data
6.1 Third-Party Services
The Service integrates with third-party services, including but not limited to Apple App Store, Google Play Store, payment processors, AI analysis providers, and voice synthesis providers. We may add or remove third-party integrations over time. While we select our integration partners with care, we do not control and cannot guarantee:
- The availability, accuracy, reliability, or functionality of third-party services
- The privacy practices or data handling of third-party services
- The continued availability of any specific third-party integration
You acknowledge that:
- Third-party services embedded in the Service have their own terms of service and privacy policies, and you are responsible for reviewing and complying with those terms
- Finsibility is not liable for any loss or damage arising from your use of or reliance on third-party services

7. Intellectual Property
7.1 Ownership
All content, features, functionality, software, text, graphics, logos, and other materials on the Service (collectively, "Content") are the exclusive property of Finsibility Inc. and its licensors and are protected by copyright, trademark, patent, trade secret, and other intellectual property laws.
7.2 Limited License
Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Service and Content for your personal, non-commercial use only.
7.3 Restrictions
You may not:
- Copy, modify, distribute, sell, or lease any part of the Service or Content
- Reverse engineer or attempt to extract the source code of the Service
- Remove any copyright, trademark, or other proprietary notices
- Use our trademarks, logos, or brand features without our prior written consent
7.4 User Content
You retain ownership of any data, information, or content you input into the Service ("User Content"), including documents you upload through the bulk import feature. By using the Service, you grant us a worldwide, non-exclusive, royalty-free license to use, store, process, reproduce, modify, adapt, and display your User Content solely to provide, maintain, and improve the Service. This license continues for so long as your account is active and terminates upon account deletion, at which point your User Content is permanently deleted from our systems. You represent and warrant that you have all necessary rights to grant this license and that your User Content does not violate any third-party rights or applicable laws. For details on how your User Content is processed, stored, and handled, please refer to our Privacy Policy.
7.5 Prohibited Content
You agree not to upload, post, or transmit any User Content that:
- Violates any applicable law or regulation
- Infringes any intellectual property or other rights of any third party
- Contains malicious code, viruses, or harmful components
- Is defamatory, harassing, or otherwise objectionable
- Contains personal information of third parties without their consent
We reserve the right to remove any User Content that violates these Terms without notice.
7.6 Feedback and Suggestions
If you provide us with feedback, suggestions, or ideas about the Service ("Feedback"), you grant us a worldwide, non-exclusive, royalty-free, perpetual, and irrevocable license to use, modify, and incorporate such Feedback into the Service without any obligation to compensate you. We are not obligated to use your Feedback.

- That the Service will help you achieve your financial goals

9. Limitation of Liability
9.1 Limitation of Damages
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL FINSIBILITY, ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, OR LICENSORS BE LIABLE FOR:
- Any indirect, incidental, special, consequential, or punitive damages
- Loss of profits, revenue, data, or use
- Loss of investment returns or financial losses
- Damages resulting from financial decisions made based on the Service
- Damages resulting from reliance on projections, forecasts, or analyses
- Damages resulting from third-party services or integrations
- Service interruptions, downtime, or unavailability
- Loss or corruption of data
- Any other damages arising out of or in connection with the Service, whether based on contract, tort (including negligence), strict liability, or otherwise
9.2 Maximum Liability
OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE USE OF OR INABILITY TO USE THE SERVICE SHALL NOT EXCEED THE LESSER OF: (A) THE AMOUNT YOU PAID TO US IN THE TWELVE (12) MONTHS PRIOR TO THE EVENT GIVING RISE TO THE LIABILITY, OR (B) FIVE HUNDRED DOLLARS ($500). In no event shall Finsibility's total aggregate liability exceed five hundred dollars ($500) regardless of the amount paid or the nature of the claim.
9.3 Financial Losses
FINSIBILITY SHALL NOT BE LIABLE FOR ANY FINANCIAL LOSSES, LOSS OF INVESTMENT RETURNS, OR OTHER ECONOMIC DAMAGES RESULTING FROM:
- Your use of or reliance on the Service
- Financial decisions made based on information, projections, or analyses provided by the Service
- Errors, inaccuracies, or omissions in the Service or Content
- Interruptions or unavailability of the Service
10. Indemnification
You agree to indemnify, defend, and hold harmless Finsibility, its affiliates, officers, directors, employees, agents, and licensors from and against any and all claims, damages, obligations, losses, liabilities, costs, or debt, and expenses (including but not limited to attorney's fees) arising from:
- Your use of or access to the Service
- Your violation of these Terms
- Your violation of any third-party right, including any intellectual property or privacy right
- Financial decisions you make based on information from the Service
- Your User Content
11. Termination
11.1 Termination by You
You may stop using the Service at any time by deleting your account through the account settings or by contacting us.
11.2 Termination by Us
We may suspend or terminate your account or access to the Service immediately, without prior notice or liability, for any reason, including if you breach these Terms. Upon termination, your right to use the Service will immediately cease.
11.3 Effect of Termination
Upon termination:
- Your right to access and use the Service will immediately terminate
- We may delete your account and User Content, subject to our data retention policies and applicable law
- You may request deletion of your data by contacting us at tos@finsibility.com
- If your account is terminated by us for violation of these Terms, all unused Rocket Coins, in-app purchases, and any other virtual items or balances associated with your account are permanently forfeited without refund or compensation. This includes, but is not limited to, termination for abuse, spam, manipulation of platform systems, or any other prohibited conduct described in these Terms.
- If you voluntarily delete your account, unused Rocket Coins and virtual items are forfeited. Refunds for unused portions of active subscriptions are governed by the applicable App Store's refund policies.
- All provisions of these Terms that by their nature should survive termination shall survive, including Sections 5 (Financial Projections Disclaimer), 7 (Intellectual Property), 8 (Disclaimers), 9 (Limitation of Liability), 10 (Indemnification), and 12 (Arbitration Agreement; Class Action Waiver; Governing Law)
12. ARBITRATION AGREEMENT; JURY TRIAL WAIVER; CLASS ACTION WAIVER; JURISDICTION AND VENUE
PLEASE READ THIS SECTION CAREFULLY. IT CONTAINS AN ARBITRATION AGREEMENT. THIS SECTION MAY SIGNIFICANTLY AFFECT YOUR LEGAL RIGHTS, INCLUDING YOUR RIGHT TO FILE A LAWSUIT IN COURT AND TO HAVE A JURY HEAR YOUR CLAIMS. THIS SECTION ALSO CONTAINS PROCEDURES FOR FINAL BINDING INDIVIDUAL ARBITRATION AND A WAIVER OF ANY AND ALL RIGHTS TO PROCEED IN A CLASS, COLLECTIVE, CONSOLIDATED, PRIVATE ATTORNEY GENERAL, OR REPRESENTATIVE ACTION (COLLECTIVELY, "CLASS ACTION") IN ARBITRATION OR LITIGATION.
THIS SECTION ALSO ADDRESSES THAT YOU AND FINSIBILITY ARE GIVING UP THE RIGHT TO HAVE A JURY TRIAL TO THE FULLEST EXTENT PERMISSIBLE BY APPLICABLE LAW AND TO FILE OR PARTICIPATE IN A CLASS ACTION SUBJECT TO THE LIMITED EXCLUSION BELOW. IN ARBITRATION, DISPUTES ARE RESOLVED BY AN ARBITRATOR, NOT A JUDGE OR JURY, AND THERE IS LESS DISCOVERY AND APPELLATE REVIEW THAN IN COURT.
12.1 Arbitration Agreement
YOU AND WE AGREE THAT ANY DISPUTE (DEFINED BELOW) SHALL BE RESOLVED BY FINAL AND BINDING INDIVIDUAL ARBITRATION EXCEPT AS OTHERWISE PROVIDED HEREIN. NOTWITHSTANDING THE FOREGOING, EITHER PARTY MAY ELECT TO HAVE INDIVIDUAL CLAIMS HEARD IN SMALL CLAIMS COURT IF THOSE CLAIMS QUALIFY FOR SMALL CLAIMS COURT AND SO LONG AS THE MATTER REMAINS IN SUCH COURT AND IS NOT REMOVED OR APPEALED TO A COURT OF GENERAL JURISDICTION AND ADVANCES ONLY ON AN INDIVIDUAL (NON-CLASS ACTION BASIS). ANY DISPUTE OVER WHETHER CLAIMS QUALIFY FOR SMALL CLAIMS COURT IS FOR THE SMALL CLAIMS COURT TO DECIDE IN THE FIRST INSTANCE AND, IF NECESSARY, FOR A COURT OF COMPETENT JURISDICTION TO DECIDE.
You and we agree that this Agreement affects interstate commerce and that the Federal Arbitration Act, 9 U.S.C. § 1 et seq., and federal arbitration law apply to this Arbitration Agreement and govern all questions as to whether a Dispute is subject to arbitration.
For purposes of this Section, the terms "Finsibility," "our," "we," or "us" include Finsibility, its subsidiaries or affiliates, as well as any of their respective present or future affiliates or subsidiaries, and any persons or entities (including agents, representatives, or employees) related to Finsibility or its present or future affiliates or subsidiaries.
For purposes of this Section, "Dispute" shall include, but is not limited to, any claims or controversies between you and we that are related in any way to this Agreement, including, but not limited to, your use of the Services, sales, returns, refunds, cancellations, defects, policies, privacy, advertising, and/or any communications between you and we, whether occurring on the Services or otherwise, even if the Dispute arises after the termination of your relationship with Finsibility. "Dispute" also includes, without limitation, claims that: (a) you bring against us; (b) we bring against you; (c) in any way relate to or arise out of any aspect of the relationship between you and Finsibility, whether based in contract, tort, statute, fraud, misrepresentation, advertising claims, or any other legal theory; (d) arose before you entered into this Agreement or out of a prior agreement with us (including, without limitation, claims relating to advertising); (e) are subject to ongoing litigation where you are not a party or a member of a certified class; and/or (f) arise after the termination of this Agreement.
"Dispute," however, does not include disagreements or claims concerning patents, copyrights, trademarks, and trade secrets and claims of piracy or unauthorized use of intellectual property or claims for personal bodily injury, which shall not be subject to arbitration or the notice and informal process described below. The arbitrator shall decide all issues except for: (a) those that are specifically reserved for a court herein; (b) those issues relating to the scope, validity, and enforceability of the Arbitration Agreement or any of the provisions of this Section; and (c) whether the arbitration administrator cannot or will not administer the arbitration in accordance with this Arbitration Agreement—all of which are for a court of competent jurisdiction to decide.
This Arbitration Agreement does not prevent you from bringing your Dispute to the attention of any federal, state, or local government agency.
12.2 Pre-Dispute Requirement
Before filing a claim, you and we agree to engage in informal dispute resolution by contacting the other party. You agree to contact us at tos@finsibility.com to attempt to resolve the dispute informally. You and we must include a statement of the claim, the grounds upon which they exist, and all supporting facts and information. We will attempt to resolve the dispute within 60 days. For a period of 60 days from the date of receipt of a completed notice from the other party, you and we will work together using reasonable efforts to try to resolve the Dispute. If requested by us in connection with a notice initiated by you, you agree to personally participate in an individualized telephone settlement conference (and if you are represented by an attorney, your attorney may also participate) to discuss a potential early resolution of the matter. If requested by you in connection with a notice initiated by us, we agree to have a Finsibility representative personally participate in an individualized, telephone settlement conference (and if we are represented by an attorney, our attorney may also participate). If the Dispute is not resolved within this 60-day period (which can be extended by agreement of the parties), you or we may commence arbitration consistent with the process set forth below. Compliance with this informal dispute resolution process is mandatory and a condition precedent to initiating arbitration.
Any applicable limitations period (including statutes of limitations) shall be tolled while the parties engage in this informal dispute resolution process.
12.3 Arbitration Administrator and Rules
Any arbitration will be administered by the American Arbitration Association ("AAA") under its Consumer Arbitration Rules then in effect (the "AAA Rules"), as modified by this Section. The AAA Rules are available at www.adr.org or by calling the AAA at 1-800-778-7879. If the AAA is unable or unwilling to administer the arbitration consistent with this Section, the parties shall agree on an alternative arbitral forum. If the parties cannot agree, either party may ask a court of competent jurisdiction to appoint an arbitrator consistent with this Section.
The arbitration will be conducted by a single arbitrator selected in accordance with the AAA Rules. The arbitrator must be a retired judge or an attorney licensed to practice law in the State of Delaware and shall have experience in the subject matter of the Dispute. The arbitrator shall be bound by the terms of this Agreement.
The arbitration shall take place in the county where you reside or at another mutually agreed location. If the claim is for $25,000 or less, you may choose whether the arbitration will be conducted (a) solely on the basis of documents submitted to the arbitrator, (b) through a telephonic or video hearing, or (c) by an in-person hearing as established by the AAA Rules. The arbitrator may award any relief that a court of competent jurisdiction could award, including injunctive or declaratory relief, but only in favor of the individual party seeking relief and only to the extent necessary to provide relief warranted by that party's individual claim.
Any arbitration hearings will take place on an individual basis, and the arbitrator's decision and award will be final and binding, subject only to the limited judicial review available under the Federal Arbitration Act, 9 U.S.C. §§ 9-11.
12.4 Arbitration Fees and Costs
Payment of all filing, administration, and arbitrator fees will be governed by the AAA Rules. If the AAA Rules require you to pay a filing fee in excess of what a court filing fee would cost in the jurisdiction where you reside, Finsibility will pay the difference. Finsibility will also pay any arbitration fees in excess of the amount you would have had to pay to file a complaint in a court of competent jurisdiction.
If the arbitrator finds that either the substance of your claim or the relief sought in the Dispute is frivolous or brought for an improper purpose (as measured by the standards set forth in Federal Rule of Civil Procedure 11(b)), then the payment of all arbitration fees will be governed by the AAA Rules and you agree to reimburse Finsibility for any fees previously paid on your behalf.
Each party shall bear its own attorney's fees and costs, unless the arbitrator determines that applicable law entitles the prevailing party to recover attorney's fees.
12.5 Class Action Waiver
YOU AND FINSIBILITY AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, COLLECTIVE, CONSOLIDATED, PRIVATE ATTORNEY GENERAL, OR REPRESENTATIVE PROCEEDING. The arbitrator may not consolidate more than one person's claims and may not otherwise preside over any form of a representative, class, or collective proceeding. The arbitrator may award relief only in favor of the individual party seeking relief and only to the extent necessary to provide relief warranted by that party's individual claim. If a court or arbitrator determines that this class action waiver is unenforceable as to a particular claim or request for relief, then this entire arbitration agreement (Section 12) shall be deemed void and unenforceable as to that particular claim or request for relief, and the claim or request for relief shall proceed in court.
12.6 Jury Trial Waiver
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, YOU AND FINSIBILITY EACH WAIVE THE RIGHT TO A JURY TRIAL FOR ANY AND ALL DISPUTES. If for any reason a Dispute proceeds in court rather than arbitration, you and Finsibility each waive any right to a jury trial and agree that such Dispute shall be decided by a judge sitting without a jury.
12.7 Right to Opt Out
You may opt out of this Arbitration Agreement (including the Class Action Waiver and Jury Trial Waiver) by sending written notice of your decision to opt out to tos@finsibility.com within 30 days of first accepting these Terms (or within 30 days of any material amendment to this Section). Your opt-out notice must include your full name, the email address associated with your Finsibility account, and a clear statement that you wish to opt out of the Arbitration Agreement. If you opt out, neither you nor Finsibility will be required to arbitrate Disputes, but all other provisions of these Terms will continue to apply to you. Opting out of the Arbitration Agreement has no effect on any other arbitration agreements that you may have entered into with us or may enter into in the future.
12.8 Severability of Arbitration Provisions
If any provision of this Section 12 is found to be illegal, unenforceable, or invalid, the remainder of Section 12 will remain in full force and effect. However, if the Class Action Waiver in Section 12.5 is found to be unenforceable as to a particular claim or request for relief and that finding is not reversed on appeal, then this entire arbitration agreement (Section 12) shall be deemed void and unenforceable as to that particular claim or request for relief, and such claim or request for relief shall be determined by a court of competent jurisdiction. Under no circumstances shall arbitration be conducted on a class, collective, or representative basis.
12.9 Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions.
12.10 Jurisdiction and Venue
For any Dispute that is not subject to arbitration or that is properly brought before a court, any legal action or proceeding arising under these Terms will be brought exclusively in the federal or state courts located in Delaware, and you hereby consent to the personal jurisdiction and venue of such courts.
13. Changes to Terms
We reserve the right to modify these Terms at any time. We will notify you of any material changes by:
- Posting the updated Terms in the Service
- Updating the "Last updated" date at the top of these Terms
- Providing notice through the Service or via email (if you have provided an email address)
Your continued use of the Service after such modifications constitutes your acceptance of the revised Terms. If you do not agree to the modified Terms, you must stop using the Service and delete your account.
14. General Provisions
14.1 Entire Agreement
These Terms, together with our Privacy Policy (which is incorporated by reference), constitute the entire agreement between you and Finsibility regarding the Service and supersede all prior agreements, understandings, negotiations, and discussions, whether oral or written. In the event of any conflict between these Terms and the Privacy Policy, these Terms shall control with respect to the subject matter of these Terms.
14.2 Severability
If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
14.3 Waiver
No waiver of any term of these Terms shall be deemed a further or continuing waiver of such term or any other term, and Finsibility's failure to assert any right or provision under these Terms shall not constitute a waiver of such right or provision.
14.4 Assignment
You may not assign or transfer these Terms or your rights hereunder, in whole or in part, without our prior written consent. We may assign these Terms or any rights hereunder without restriction.
14.5 Force Majeure
We shall not be liable for any failure or delay in performance under these Terms due to circumstances beyond our reasonable control, including natural disasters, war, terrorism, labor disputes, or failures of third-party services.
14.6 International Use
The Service is controlled and operated from the United States. If you access the Service from outside the United States, you are responsible for compliance with local laws. We make no representation that the Service is appropriate or available for use in other locations. Access to the Service from territories where the Service is illegal is prohibited.
14.7 Export Controls
You agree to comply with all applicable export and re-export control laws and regulations, including the Export Administration Regulations maintained by the U.S. Department of Commerce and trade and economic sanctions maintained by the U.S. Treasury Department's Office of Foreign Assets Control.
14.8 DMCA Notice
If you believe that any content on the Service infringes your copyright, please contact us at tos@finsibility.com with a DMCA takedown notice that includes: (1) identification of the copyrighted work; (2) identification of the infringing material; (3) your contact information; (4) a statement of good faith belief; (5) a statement of accuracy; and (6) your signature.
14.9 Mobile App Store Terms
If you access the Service through a mobile application downloaded from the Apple App Store or Google Play Store, you acknowledge that:
- These Terms are between you and Finsibility, not with Apple or Google
- Apple and Google are not responsible for the Service or its content
- Your use of the Service must comply with the applicable App Store terms of service
- Apple and Google have no obligation to provide support or maintenance for the Service
- In the event of any failure of the Service to conform to any applicable warranty, you may notify Apple or Google, and they may refund the purchase price (if applicable) to you, and to the maximum extent permitted by law, Apple and Google will have no other warranty obligation
14.10 Beta and Experimental Features
We may offer beta, experimental, or preview features that are still under development. These features may be unstable, contain errors, or be discontinued at any time. We make no warranties regarding beta or experimental features, and you use them at your own risk.
Beta Environment Security Notice: If you are using the Service during a beta or pre-production phase, please be aware that data is encrypted both in transit and at rest. However, pre-production environments may use less restrictive access controls and data isolation practices than production. We recommend that you exercise caution with highly sensitive financial information during beta testing. Please refer to our Privacy Policy for details about security measures.
14.11 Advertisements
We reserve the right to display advertisements on our platform. Advertisements may appear within the Service interface, and we may partner with third-party advertising networks to serve ads. If we display advertisements, they will be clearly identified as such. Premium subscription plans may include an ad-free experience. Even if we display advertisements, we will never sell your personal data to advertisers.
